Terms & Conditions
These terms govern access to and use of the eBen platform, website and related services offered by eBen FZE, an eBHL company.

1. Scope & definitions
These Terms & Conditions ("Terms") apply to your access to and use of the websites, platforms, mobile experiences and related services operated by eBen FZE, a company registered in the United Arab Emirates and part of the eBHL group of companies ("eBen", "we", "us" or "our"). They apply whether you access eBen as an employer client, an individual employee acting under an employer's account, a benefit vendor, a community member, a co-seller, or a general visitor to our website (together, "Users").
In these Terms, "Services" means the eBen Benefits Center, Success Advocate, Recognition Suite, Sentiment Platform, Consulting & Advisory offering, CeeL programming, Vendors Network and any other product, feature or service made available by eBen from time to time. "Content" means any text, data, files or materials submitted to or generated within the Services.
2. Eligibility & accounts
Access to most Services is provisioned through an employer, vendor or partner organization that has entered into a separate commercial agreement with eBen. Individual Users typically receive access as employees, members or contacts of that organization and must use the credentials issued to them responsibly.
- You must provide accurate information when creating or updating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify eBen promptly of any suspected unauthorized use of your account.
- Accounts are personal to the individual or organization to which they are issued and may not be transferred without our consent.
3. Acceptable use
You agree to use the Services only for lawful purposes and in a manner consistent with their intended employee-experience, benefits, recognition and community functions. Without limiting the foregoing, you must not:
- Upload or transmit unlawful, defamatory, harassing, discriminatory or infringing content;
- Attempt to gain unauthorized access to any account, system or network connected to the Services;
- Reverse engineer, decompile or attempt to extract the source code of any eBen software;
- Use the Services to send unsolicited communications or to scrape, harvest or resell data;
- Interfere with the proper functioning of the Services, including via malware or denial-of-service activity;
- Misrepresent your identity or affiliation, or impersonate another individual or organization; or
- Use the Services in a manner that breaches applicable UAE law or the law of the jurisdiction from which you access them.
4. Customer data & responsibilities
Employer clients and vendor partners remain responsible for the accuracy and lawfulness of the data they submit to or through the Services, including employee-context data used to configure benefits, recognition or sentiment programs. Clients must ensure they have the necessary rights and, where applicable, employee notices or consents in place before submitting personal data to eBen. eBen processes such data as described in our Privacy Policy.
5. Subscriptions, fees & renewal
Access to paid Services is subject to the fees, billing cadence and renewal terms set out in the applicable order form or commercial agreement between eBen and the client. Except as otherwise agreed in writing, subscriptions renew automatically for successive terms unless either party provides notice of non-renewal within the period specified in that agreement. Fees are quoted and invoiced separately from this general Terms page and are not published here.
6. Service levels & support
Service-level commitments, support hours, response-time targets and escalation procedures are defined in the applicable commercial agreement or support schedule. Where no specific service-level agreement applies, eBen will use commercially reasonable efforts to keep the Services available and to respond to support enquiries during standard UAE business hours.
7. Intellectual property
The Services, including all software, design, text, graphics and underlying technology, are the property of eBen or its licensors and are protected by applicable intellectual property laws. Subject to your compliance with these Terms, eBen grants you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. Content that a client or User submits remains the property of that client or User, subject to the license needed for eBen to operate the Services.
8. Third-party vendors & benefit offers
The Vendors Network and Benefits Center may surface offers, discounts or products supplied by third-party benefit vendors. eBen facilitates the discovery, presentation and administration of these offers; the vendor is solely responsible for the delivery, quality, pricing and fulfillment of its own products or services. eBen is not a party to the contract between a vendor and an employee or employer who takes up an offer, and disputes regarding a specific offer should be directed to the relevant vendor in the first instance.
9. Service availability & modifications
eBen aims to keep the Services available and performant but does not guarantee uninterrupted or error-free operation. We may suspend access for scheduled maintenance, security reasons or circumstances beyond our reasonable control, and we may modify or discontinue features with reasonable notice where practicable. Support channels and response expectations for clients are set out in the applicable commercial agreement; general enquiries can be directed to welcome@eben.work.
10. Confidentiality
Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information of similar nature, and not to disclose it to third parties except as necessary to perform its obligations, as required by law, or as otherwise agreed in a governing commercial agreement.
11. Limitation of liability
To the maximum extent permitted by applicable law, eBen shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to the use of the Services. Nothing in these Terms limits liability that cannot be excluded under UAE law.
12. Term & termination
These Terms remain in effect for as long as you access or use the Services. eBen may suspend or terminate access where a User materially breaches these Terms, where required by law, or in accordance with the termination provisions of the applicable commercial agreement. Certain provisions, including intellectual property, confidentiality and limitation of liability, survive termination.
13. Governing law & changes
These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the relevant Emirate in which eBen is registered, without prejudice to any mandatory consumer protections that may apply.
We may update these Terms from time to time to reflect changes in our Services or legal requirements. Material changes will be indicated by an updated "Last updated" date on this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
